Defendants’ summary judgment motion presents, inter alia, the question whether a Virginia county can validly assign to a developer its rights under a subdivision agreement and performance bond. In connection with the development of certain property in Loudoun County, the County entered into a subdivision agreement with the property owner defendant USX Corporation (“USX”) and a performance bond with Federal Insurance Company (“Federal”).
