Plaintiff McDonald’s Corporation (McDonald’s) originally filed this action against defendant C.B. Management Co., Inc. (CB) on August 29, 1997, seeking injunctive and monetary relief for CB’s alleged violation of its franchise agreement and illegal use of McDonald’s trademarks. This court’s jurisdiction arises under 28 U.S.C. § 1332, and 28 U.S.C. § 1338.
