Before the Court are the plaintiffs’ motion for summary judgment and the defendant Town of Fairhaven’s (the “Town’s”) cross motion for the same. The defendant Fairhaven Wind, LLC (“Fairhaven Wind”) filed a memorandum in support of the Town’s position, but it submitted that, as to the claims pending against it, the plaintiffs’ motion was premature because of the need for discovery as to several material issues.
