PIVARNIK, Justice.

Defendant-appellant David Garrett was convicted of the theft of a motorcycle in the Decatur Circuit Court. He subsequently appealed that conviction claiming that the trial court erred in refusing to grant his motion to suppress certain evidence. The First District Court of Appeals, Judge Neal dissenting, held that the trial court should have granted Appellant's motion to suppress and accordingly reversed his conviction and remanded his cause for a new trial.
