Shannon Dawson filed the instant personal injury suit asserting, inter alia, negligence claims against Wal-Mart Stores, Inc.,1 stemming from an incident during which she was attacked and kidnapped from the Baxley, Georgia, store at which she worked and was thereafter physically and sexually assaulted by the perpetrator. Wal-Mart answered and filed a motion to dismiss or alternatively for summary judgment on the ground that Dawson’s claims against it were barred by the exclusive remedy provision of the Georgia Workers’ Compensation Act.2 The trial court granted the…
