Error to Livingston. Criminal Information for breaking and entering in tlie night time a store not connected with a dwelling, with intent to steal. The facts are in the opinion.

The information in this case, a copy of which is given in the margin, * was for the statutory offense of breaking and entering a certain store in the night time with intent to commit larceny therein. The information was filed September 26, 1876, but by some clerical error the time of the alleged offense was given as December 25, *5471876. This error is now relied upon as a ground for a reversal of the judgment.
