Defendant was convicted after a jury trial of two counts of felony murder (Penal Law § 125.25 [3]) (the fifth and sixth counts of the indictment) for causing the deaths of Susan Rees and Jason Hanlin, her son, by starting a fire in the two-family dwelling at 88 Spaulding Street in Buffalo where they resided.
