Appeal from a judgment of the County Court of Tompkins County (Sherman, J.), entered March 12, 2008, upon a verdict convicting defendant of the crime of murder in the second degree (two counts).

Defendant was charged in an indictment with murder in the second degree (three counts), aggravated sexual abuse in the second degree (two counts), and endangering the welfare of a child. The charges related to a May 2007 incident in which defendant, while caring for her two-year-old niece, sexually assaulted the child, battered her and left her to drown.
