Pending before the court is Plaintiffs Motion to Remand (# 2), wherein Plaintiff David Carnes (“Carnes”) seeks remand of this action to the state court in which it was originally filed. Having reviewed the pending motion, the submissions of the parties, the pleadings, and the applicable law, the court is of the opinion that remand is warranted.
