Upon the first trial of this case it was transferred to this court and a decision was rendered overruling the defendant’s motion for a directed verdict, but setting it aside on the ground of misconduct of the jurymen in reaching a verdict for the plaintiff. Doody v. Railroad,, ante, 161. It was held that the evidence of the defendant’s negligence and the plaintiff’s care under the circumstances was sufficient to sustain a verdict in his favor.
