On October 15, 1929, the Pennzoil Company, a corporation organized under the laws of the state of California, and having its principal place of business at Los Angeles, filed its petition in the United States Patent Office for cancellation of the appellant’s trade-mark, under section 13 of the Trade-Mark Act of February 20, 1905, as amended; U.S.Code, title 15, § 122 (15 U.S.C.A. § 122).
