Appeal from a judgment of the County Court of Clinton County (Ryan, J.), rendered October 10, 2000, upon a verdict convicting defendant of the crime of burglary in the second degree.

Defendant was indicted for the crime of burglary in the second degree in connection with an incident that occurred in October 1999 at the home of Shirley Balko (hereinafter the victim).
