CARTER, Justice.
Petitioner, Mark Edward Manders, Jr., appeals from an order on judicial review of agency action which upheld the action of respondent, Iowa Department of Transportation, in revoking his license to operate a motor vehicle. The basis for the agency’s action in revoking petitioner’s license was his alleged refusal to submit to chemical testing of his blood alcohol content when requested to do so in violation of Iowa Code section 321J.9 (1987).
