APPEL, Justice.
This case involves a challenge by a defendant to the State’s voluntary dismissal of a criminal charge for operating a motor vehicle while intoxicated. The defendant asserts that the dismissal was not “in the furtherance of justice” as it avoided a determination on the merits of his pending motion to suppress.
