A motion for dismissal in the interest of justice has been made, pursuant to CPL 170.40.
The defendant was charged with crimes resulting from an altercation with a court officer, employed by the State of New York, acting in the course of his employment. The District Attorney offered an adjournment in contemplation of dismissal (A.C.D.) (CPL 170.55) at Bench conferences on three *413separate occasions, on the condition that Mr. Wilmot "waive any civil remedies he might have arising from the same factual circumstances surrounding the criminal prosecution”.
