In a proceeding pursuant to CPLR article 78, inter alia, to compel the appellants New York State Department of Environmental Conservation and Commissioner Henry G. Williams (hereinafter referred to jointly as the DEC) to process the petitioner’s State Pollution Discharge Elimination System (hereinafter SPDES) permit, the appeal is from a judgment of the Supreme Court, Rich*664mond County (Kuffner, J.), dated February 10, 1986, which granted the petition.
Ordered that the judgment is reversed, on the law, without costs or disbursements, and the proceeding is dismissed.
