Appeal from a judgment of the general term of the Superior Court of the city @f New York affirming a judgment dismissing the complaint rendered upon a trial by the court without a jury. The action was brought for the conversion of certain personal property consisting of lithographic drawings dr engravings upon stones originally owned by the Hatch Lithographic Company, and which came into defendant’s possession through the foreclosure of a chattel mortgage executed by that company. The plaintiff entered into a contract with the Hatch Lithographic Company, by which the latter was to perform services in making lithographic drawings or impressions on stone, from which prints or colored lithographs were to be printed from time to time for the plaintiff, at agreed prices. The drawings became the property of the plaintiff, while the stones upon which the impressions were made and taken belonged to the Hatch Lithographic Company.
