Appeal from a judgment of the superior court for King county, Albertson, J., entered November 21, 1905, upon the verdict of a jury rendered in favor of the plaintiff, in an action to recover damages for the breach of a contract of marriage.

This is an action by respondent to recover damages against appellant for breach of contract of marriage. From a judgment in favor of respondent, the case comes here on appeal.

The principal defense urged by appellant is that respondent, at the time of the mutual promises of marriage, was *490afflicted with pulmonary tuberculosis (commonly called ’consumption), in an incurable form, and has ever since been physically incapable of entering into the marriage relation.
