The Commonwealth of Pennsylvania (Commonwealth) 1 appeals from an order of the Court of Common Pleas of Cumberland County (trial court) that granted Frank Crespo’s (Crespo) motion for return of property.
On November 14, 2008, Crespo was arrested outside of the Highmark Blue Cross Blue Shield cafeteria and charged with the criminal offense of selling counterfeit merchandise in violation of Section 4119(a) (Trademark counterfeiting) of the Act, 18 Pa.C.S. § 4119(a). 2 Some of the counterfeit merchandise seized included trademarks such as “Gucci”, “Coach”, “Louis…
