BUFFINGTON, Circuit Judge.

In the court below the Struthers-Wells Company, here called the plaintiff, brought suit against the Haminerschiag Alanufacturiug Company, the defendant, to recover $30,000, the purchase price for a gas engine furnished upon a written contract. The engine was built by plaintiff and erected in defendant’s factory. The latter refused to accept or pay for the same, alleging it did not comply with the contract.
