HARPER, Judge.

Appellant was prosecuted and convicted of the offense of rape on a girl under fifteen years of age, and his punishment assessed at five years confinement in the State penitentiary.

In a bill of exceptions it is shown that the prosecuting officer placed W. T. Russell on the witness stand, and attempted to prove a conversation between Mr. Russell and Mr. Orr, the father of the girl alleged to have been raped. Mr. Russell was one of the attorneys for appellant on this trial, but he had not been employed at the time the conversation took place between himself and Mr. Orr. The court…
