MEMORANDUM AND ORDER

SAFFELS, District Judge.

This matter is before the court on the defendant/movant’s motion for modification and/or correction of a sentence under 18 U.S.C. § 3582(c)(1) (Doc. 129).

18 U.S.C. § 3582(c)(1)(A) is not applicable in this case, as it addresses modification of sentences upon motion of the Director of Prisons. 18 U.S.C. § 3582(c)(1)(B) provides that “the court may modify an imposed term of imprisonment to the extent otherwise expressly permitted by statute or by Rule 35 of the Federal Rules of Criminal Procedure.” Because there is no statute expressly permitting…
