MEMORANDUM OPINION & ORDER

SULLIVAN, District Judge.

This case comes before the Court on defendant’s motion to dismiss the complaint. Because defendant’s motion turns on the preclusive effect of a prior judgment of the United States District Court for the Eastern District of Virginia, this Court sua sponte solicited supplemental briefing regarding whether this case should be transferred to that forum for ultimate disposition.
