This is an action to recover an assessment levied against Andrew J. Dinnen as a stockholder of the Bank of United States. The action, when originally tried, resulted in the entry of a judgment in favor of the Superintendent of Banks against the defendant as a stockholder of 111 shares of the capital stock of the bank. This judgment was affirmed by the Appellate Division without opinion (Broderick v. Adamson, 148 Misc. 353; affd., 243 App. Div. 692).
