Appeal from Dubuque District Court. — D. E. Maguire, Judge. The defendant, was indicted upon charge of rape, committed on the person of one Dorothy S. Hoffman. Trial was had to a jury, which returned a verdict of guilty of assault with intent to commit rape. Motion for new trial was denied, and defendant, having been sentenced to imprisonment in the penitentiary for the term of 20 years, appeals from said judgment.—

1' weight andesut-: ficiency. — The complaining witness is a married woman, 24 years of age, and at the time of the alleged assault, she was living with her husband on a farm in Dubuque County, not far from the town of Dyersville. The defendant, William Thomas, Jr., commonly called “Jimmie, ” by wliich name he is spoken of in the record, is an unmarried man, 33 years old; and at the time in question, he was living with his parents on a farm adjoining the one occupied by the complaining witness and her husband, *1005Leo Hoffman.
