Appeal from a judgment of the County Court of Franklin County (Main, Jr., J), rendered February 26, 2001, convicting defendant upon his plea of guilty of the crime of attempted promoting prison contraband in the first degree.

*613When this matter was previously before us (290 AD2d 730), we found possible merit to defendant’s claim of untimely prosecution.
