ORDER
MIHM, District Judge.
Before the Court is a Motion by the United States of America for summary judgment (# 47) against claimants Randall Sorrells and Cathy Sorrells. The Court denies this Motion.
BACKGROUND
The United States of America seeks judicial forfeiture of the above-described real estate owned by Randall and Cathy Sor-rells which is subject to a note and mortgage to Investors Residential Mortgage Corporation.
