delivered the opinion of the court.
Michael O’Leary was struck and run over on the 13th day of October, 1900, at about 8:15 p. m., at a street crossing in the village of Odell, by a locomotive on appellant’s tracks drawing a train of freight cars. He received injuries from which he died about an hour later, and his administrator brought this suit to recover damages for his next of kin. The first trial of the case resulted in a verdict for the defendant which the court set aside. The second trial resulted in a verdict for plaintiff upon which judgment was rendered. Upon appeal…
