Appellee (hereinafter designated as plaintiff), a resident of Covington, Kentucky, while employed as a switchman by appellant (hereinafter designated as defendant), in the Decoursey Yards, near Covington, Kentucky, was injured on the third day of July 1938 by the alleged negligence of defendant, in being knocked from the top of a ladder on the side of a freight car that he was then engaged in switching, thrown to the ground and injured.
