In these combined cases the plaintiff appeals from the judgments of the trial court dismissing his appeals from the Probate Court. The plaintiff was the named executor of the estate of the decedent, Ruth J. Robbins. The defendants were numerous nieces and nephews of the decedent, three of whom, Patricia P. *458Smith, Jennifer Place, and Ruth Carr, brought the motions to dismiss the plaintiff’s appeals from probate.
