Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered December 19, 1994, convicting defendant upon his plea of guilty of the crime of criminal possession of a controlled substance in the second degree.

Defendant was found to be in possession of more than four ounces of cocaine and was charged with criminal possession of a controlled substance in the first degree and criminal possession of a controlled substance in the third degree. He pleaded guilty to criminal possession of a controlled substance in the second degree and was sentenced as a second felony…
