ORDER

DOTY, District Judge.

This matter is before the court on the separate motions of defendants St. Mary’s Hospital and Ruhof Corporation for summary judgment. 1 Based on a review of the file, record and proceedings herein, the court grants both defendants their motions for summary judgment as to the existence of a private cause of action under the statutes pled by plaintiffs and dismisses the complaint without prejudice for lack of jurisdiction.
