HARWOOD, Judge.

In the suit below a verdict was returned in favor of the plaintiff on count 3 of his complaint, and his damages were fixed at $1,000. Judgment being entered pursuant to the verdict the defendant perfected an appeal to this court.

Count 3, a simple negligence count, was as follows:

“Plaintiff claims of the Defendant the sum of $10,000.00 as damages for that heretofore on, to-wit: September 3, 1952, Defendant was engaged in operating a taxi, or common carrier for hire, in Evergreen, Conecuh County, Alabama, and that Plaintiff, a fare-paying passenger, was being driven along the…
