MEMORANDUM OPINION AND ORDER

RUBEN CASTILLO, District Judge.

Eight medically fragile disabled individuals currently receive funding from the Illinois Department of Healthcare and Family Services (“DHFS”) for approximately 16 hours a day of in-home skilled nursing services. These services allow the disabled individuals, Plaintiffs in this case, to avoid constant hospitalization.
