The plaintiffs originally brought this action against the defendants, John Parigian (“Parigian”), a refinancing agent who is now a fugitive, and O. Roland Orlandi (“Orlandi”), a lawyer who is now deceased, alleging the wrongful diversion of the plaintiffs’ monies. In 2000, the Court (Fecteau, J.) entered a default judgment against Parigian and the plaintiffs now seek monetary damages against Orlandi’s estate3 pursuant to the following claims, as will be explained below, which survive the death of Orlandi: partnership liability (Count I), money had and received (Count X),…
