Thompson, J.:

A single engine Bellanca aircraft, owned by Martin, was damaged when it crashed while being piloted by Ross who had *917borrowed the plane. Alleging ordinary negligence, Martin commenced this action against Ross to recover damages for the loss thus sustained.

The cause was presented to the court without a jury. At the close of the plaintiff’s case the court granted the defendant’s NRCP 41(b) motion to dismiss believing that the plaintiff had failed to prove a case.
