OPINION AND ORDER ON THIRD-PARTY DEFENDANTS’ MOTION FOR SUMMARY JUDGMENT

I. Introduction
A jury trial is scheduled in the above-captioned cases for January 26, 2010. Third-Party Defendants Matthew Dolling-er and Dollinger, Gonski, & Grossman (hereinafter “Dollinger”) have moved for summary judgment with respect to all claims asserted by Stonewell and Gladstone (collectively, “Stonewell”) in their Third-Party Complaint.
