James M. Seely, a resident of the city of Eochester, N. Y., died on April 4, 1900, leaving a last will and testament, which was admitted to probate by the surrogate of Monroe county, and letters testamentary were issued to the defendant Eochester Trust and Safe Deposit Company, named as executor in the will, and also trustee of certain trusts which it created. Among the assets of the estate were about $80,000 in bonds and mortgages upon real property in the city of Detroit, Mich.
