It is conceded by' counsel in their well considered briefs that tbe case agreed presents for decision tbe question whether, at tbe time of sale by tbe sheriff and purchase by tbe plaintiff, tbe interest of tbe judgment debtor in tbe locus in quo was subject to sale under execution. His Honor in bis carefully prepared opinion and judgment makes an able and exhaustive review of tbe cases decided by this Court and answers tbe question in tbe affirmative, rendering judgment for the plaintiff.
