This action was commenced in tbe Superior Court of Grant county, May 14,1916, by tbe *51appellee against the appellant on a fire insurance policy, for damages for the loss of a building by fire, such building being a portion of the property covered by said policy. The policy contains the following provision :
“If the premises described shall be occupied for other than farm purposes or if any of the buildings described are now vacant, unoccupied or uninhabited, or shall become vacant, unoccupied or uninhabited, and so remain for a period exceeding ten days, without written consent hereon, then * *…
