Error from the District Court of Travis. Tried below before Hon. F. G. Morris. Amelia Hall and husband sued the city of Austin, and appealed from a judgment dismissing the case.

KEY, Associate Justice.
In the court below, this case was dismissed for the want of prosecution. On the day following the order of dismissal, the plaintiffs filed a motion asking to have that order set aside and the case reinstated.
In support of the motion the plaintiffs made an affidavit, stating, in substance, that they resided about nine miles from the courthouse in the city of Austin; that the plaintiff Amelia Hall reached the courtroom at about 10 o’clock a. m. on the day the suit was dismissed; that while waiting for the case to be called, it became necessary for her to go down stairs to…
