There is virtually no dispute about the facts in this controversy. On May 18, 1940, the plaintiff in error, hereinafter referred to as plaintiff, was granted a divorce from the defendant in error, hereinafter referred to as defendant. She was given the custody of the three then minor sons of the parties and the defendant *458was ordered to pay plaintiff $15 per week for child support.

On February 15, 1941, the plaintiff remarried and she, her husband and the three minor children movjed to California where they resided at the time of this trial. On September 17, 1942, the defendant enlisted in the…
