DUNKLIN, Justice.

A. A. Cooper instituted a suit in the justice court of Young county against S. P. Upham and J. A. Upham, doing business in Olney, Tex., as a copartnership under the firm name of Oity Gas Company, to recover the sum of $15. The defendants in that suit filed a cross-action to recover of the plaintiff the sum of $184.25.

The case was tried in the justice court and a judgment was rendered in plaintiff’s favor for the sum of $5.38, dismissing the cross-action on motion of plaintiffs by reason of the fact that no evidence was introduced in support thereof.
