Motion is made to set aside a verdict rendered in favor of plaintiff and to dismiss the complaint. The complaint alleges that plaintiff was injured by reason of the negligent maintenance of an appliance on one of the defendant’s cars.
The plaintiff, a .porter, employed by certain dressmakers and tailors, testified: He boarded a north-bound car at Thirty-Fourth street and Sixth avenue. The seats were all taken and people were standing in the aisles, the door was blocked, and there were people standing on the platform.
