delivered the opinion of the court.

This is an action in assumpsit by appellee against appellant upon a policy of insurance. The declaration avers the issuance of the policy, the total destruction by fire of the property covered, and that the value of the same was the full amount of the policy, to-wit, $325. A summons was duly issued on March 4,1904, returnable to the July term of the County Court, which was served upon the defendant on March 14, 1904.
