Appeal from a judgment of the Supreme Court (McGrath, J.), entered March 3, 2009 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of respondent Department of Education denying petitioner clearance for employment.

In August 2007, petitioner was temporarily hired by the City of Syracuse School District as a custodian.
