MEMORANDUM
HERMAN, District Judge.
I. BACKGROUND
This case was initiated by the filing of a Complaint on September 8, 1981. The Plaintiffs alleged, essentially, that the Pennsylvania Solicitation of Charitable Funds Act, 10 P.S. §§ 160-1 et seq., (hereafter “the Act”) is unconstitutional. A request for a preliminary injunction was denied on October 21, 1981. 523 F.Supp. 1377. The action was subsequently, stayed pending the Pennsylvania Supreme Court’s decision in Commonwealth of Pennsylvania v.
