This matter is before the Court on Defendant’s Motion for Summary Judgment, and Plaintiff’s Motion to Dismiss Defendant-Claimant’s Claim. Alternatively, Plaintiff seeks summary judgment. The case arises out of a civil forfeiture action brought by the United States against Defendant vehicle for its alleged use in facilitating the transportation and sale of heroin, in violation of 21 U.S.C. §§ 812 and 881(a)(1).
