Troy Cole, plaintiff in error, herein referred to as the defendant, was charged with statutory rape in the second degree for having sexual intercourse with Jewel Holloss, a female over the age of 16 years and. under the age of 18 years, of previous chaste character. By verdict of a jury he was found guilty as charged, with his punishment fixed at confinement in the penitentiary for a term of three years.
