The appellant, Neilsen, was indicted for uttering a forged instrument, and was tried and convicted thereon and sentenced to the penitentiary.

The appellant first made a motion to quash the indictment, setting up in the motion that the indictment purported to have been found and presented on March 12, 1927, when in truth and in fact the grand jury of the circuit court of Pike county had taken recess from "Wednesday, March 9th, until Tuesday, March 15th, and if this indictment was presented on March 12th, in open court, as required by law, it was presented during a recess of the grand jury, as…
